The Court of Justice of the European Union (ECJ) ruled on 04 July 2019 that the mandatory minimum and maximum rates of the HOAI are contrary to European law and therefore no longer apply.

The Federal Chamber of Architects has compiled information material on the judgement on its website, including a legal initial evaluation of the decision.

Even if the ruling does not mean the end of the entire HOAI, it has significant implications for landscape architecture firms in terms of contract design and increases the economic risks.

At the seminar of the bdla the current state of discussion and the consequences both for the offices and for the profession and the bdla are discussed and activities are derived. bdla lawyer Dr. Sebastian Schattenfroh will explain the fee and contract-legal consequences and give practical references for the occupation everyday life. The political and professional classification will be taken over by Dr. Volker Schnepel, Federal Chamber of Architects. He will report on the coordination status of the HOAI reform from the point of view of the chambers and associations.
