The bdla has published two leaflets on the current status of the HOAI amendment. They explain the findings of the expert report and provide the parties involved with arguments and practical guidance on ensuring appropriate and adequate remuneration.
The collapse of the previous coalition government comprising the SPD, Alliance 90/The Greens and the FDP prevented the reform of the HOAI. Yet the groundwork had already been laid in the form of two expert reports:
- the ‘Evaluation of Planning Sectors’, commissioned by the Federal Ministry of Housing, Urban Development and Construction,
- and an expert report on the ‘Evaluation of the Fee Tables’ of the HOAI, commissioned by the Federal Ministry for Economic Affairs and Climate Action.
These two expert reports provide a solid foundation and demonstrate to the responsible clients/contracting authorities, as well as to service providers and contractors of architectural and engineering services what requirements apply to the provision of services in line with current standards, and what fee scale values the HOAI would need to reflect today in order to match the remuneration level established in the last fee scale evaluation following the 2013 HOAI amendment.
The publication of the fee report by the Federal Ministry for Economic Affairs and Climate Protection also means that public contracting authorities can no longer rely solely on the current fee scales of the HOAI 2021 when forecasting the expected scope of the contract or evaluating a tender price. Rather, the fee tables now published in the fee report represent new reference values for the remuneration of basic services under adjusted requirements and framework conditions.
