With the first Bavarian Modernisation Act, the previous option for local authorities to enact their own open-space planning regulations has been abolished. At the same time, the new Bavarian Building Regulations provide an alternative regulatory option: in future, towns and local authorities will be able to prohibit soil sealing, non-green rockeries and similar monotonous land uses that place a high thermal or hydrological burden on the environment or have low ecological or residential climate value.
An interdisciplinary working group comprising landscape architects and lawyers from the Bavarian Chamber of Architects and the Bavarian Association of Local Authorities has drawn up a range of options for by-laws on this subject. The aim was to provide technical definitions of the new legal terms and to make them practicable for local authorities.
The model open space by-law adopts a quality-oriented approach, creates a flexible framework for the design of open spaces and reinforces their contribution to climate adaptation, rainwater management, heat protection and biodiversity in built-up areas. It can thus serve not only in Bavaria but, in the long term, nationwide as a tool for implementing the EU’s renaturation targets in built-up areas.
On 23 February at 5.00 pm, the model by-law will be presented online as part of the 2026 Chamber elections in Bavaria.
